What is a Nebenkostenabrechnung?
The Nebenkostenabrechnung (literally: "ancillary cost statement") is your landlord's annual breakdown of shared running costs for the building you live in. In English it's sometimes called a utility cost statement, operating cost statement, or service charge reconciliation.
Your rent in Germany is typically made up of two parts: the Kaltmiete (cold rent — the pure rent for the flat itself) and a Nebenkostenvorauszahlung (advance payment for ancillary costs). Each month you pay both. The advance payment is an estimate — and once a year, your landlord calculates the actual costs and sends you the Nebenkostenabrechnung.
If the actual costs were higher than your monthly advance payments, you owe the difference (Nachzahlung). If the costs were lower, you're entitled to a refund (Guthaben).
What costs are included — and what isn't allowed
Not every cost can be passed on to tenants. German law (the Betriebskostenverordnung — BetrKV) defines exactly which operating costs (Betriebskosten) are chargeable. If a cost isn't on the list, your landlord can't bill you for it.

How are costs divided between tenants?
In a multi-tenant building, shared costs need to be split between flats. The method used is called the Verteilerschlüssel (distribution key). Your lease should specify which method applies for each cost category.
The most common distribution keys are:
- Wohnfläche (living area in m²) — your flat's size as a proportion of the total building area. Most common for general costs.
- Personenzahl (number of occupants) — used for water and waste costs in some buildings.
- Verbrauch (actual consumption) — required for heating and hot water by law (Heizkostenverordnung). At least 50% of heating costs must be split by actual usage, measured by meters in each flat.
- Wohneinheiten (number of flats) — equal split regardless of size. Less common.
Check that the distribution key used matches what's stated in your lease. Landlords can't switch methods mid-year without notice.
Key sections to check on your statement
1. The billing period (Abrechnungszeitraum)
The Nebenkostenabrechnung must cover exactly one year. If you moved in or out mid-year, costs should be pro-rated for the period you were a tenant — not charged for the full year.
2. Your advance payments (Vorauszahlungen)
The statement must credit every advance payment you made during the year. Cross-reference these against your bank statements. Errors here — payments missed or understated — are one of the most common sources of incorrect bills.
3. The cost breakdown (Kostenaufstellung)
Each cost category should be listed with the total building cost and your share. Your landlord must be able to provide receipts and invoices for every item if you request them. This is your right under §259 BGB.
4. Heating costs (Heizkosten)
These are subject to the Heizkostenverordnung and must be split partly by actual consumption (minimum 50%) and partly by living area. If your statement doesn't show a consumption-based split for heating, it may not be legally compliant — and you're entitled to a 15% reduction in the heating bill.

Studies by German tenants' associations (Mieterverein) consistently find that a significant minority of Nebenkostenabrechnungen contain errors — often in the landlord's favour. The most common ones are:
- Costs that shouldn't be there — repairs, management fees, or costs not listed in your lease as chargeable Betriebskosten.
- Wrong distribution key — calculating your share by a different method than your lease specifies.
- Missing advance payments — your monthly payments not fully credited against the total.
- Incorrect living area — using a higher m² figure than your lease states.
- Costs from outside the billing period — invoices from a different year included in this year's statement.
- Heating not split by consumption — violates the Heizkostenverordnung and entitles you to a 15% reduction.
Your deadline to object (Widerspruch)
If you believe your Nebenkostenabrechnung contains errors, you have 12 months from receipt of the statement to formally object — this is called a Widerspruch. After that deadline, German courts have generally held that the right to object lapses (BGH rulings on §556 BGB).
A Widerspruch must be in writing and should specify exactly which items you are disputing and why. Vague objections ("I think this is too high") are not sufficient. You should request the underlying invoices first, then make a specific challenge once you've reviewed them.
Pay the amount stated in the meantime if you receive a Nachzahlung demand — withholding payment while you dispute is risky and could count as arrears. Object formally while paying, then pursue the refund.
What happens after you object?
If your landlord accepts your objection, they'll issue a corrected statement and refund any overpayment. If they reject it, you have the option to pursue the matter through a German civil court — though for most disputes, mediation via the Mieterverein is faster and cheaper.
Your landlord must also respond to requests for invoices and receipts within a reasonable time. If they refuse to provide documentation, that itself can support your objection.
